These terms and conditions govern your charter agreement with Phinisi Charter. By booking with us, you agree to abide by these terms. Please read carefully.
1. Acceptance & Agreement
By submitting a booking inquiry, requesting a proposal, or paying any deposit toward a charter with Phinisi Charter, you accept these terms and conditions in their entirety. These terms constitute a legally binding agreement between you and Phinisi Charter. If you do not agree with any provision, you may not book with us.
Your booking confirmation email confirms your acceptance of these terms and your charter agreement. Keep this documentation for your records.
2. Booking & Reservations
Reservation Process
Chartering proceeds in stages: (1) Initial inquiry and proposal, (2) Deposit payment to secure dates, (3) Final balance payment 30 days before charter, (4) Pre-charter coordination and documentation.
Deposit Requirements
A 30% deposit of the total charter cost is required to confirm your booking and secure vessel availability. The balance is due 30 days before your charter date. Deposits are non-refundable except as outlined in our cancellation policy.
Availability & Confirmation
Charter dates are confirmed upon receipt of deposit payment. Your booking confirmation email details your charter vessel, dates, and terms. Verify all details immediately and report any errors.
3. Payment Terms
Accepted Currencies & Methods
We accept payment in USD. Accepted methods include international bank transfers, credit card payments (Visa, Mastercard), and PayPal. Specific payment instructions are provided with your proposal.
Payment Schedule
- Deposit: 30% due upon booking confirmation
- Balance: 70% due 30 days before charter start date
- Late Payment: Late payments may result in booking cancellation without refund
Currency & Exchange
Prices are quoted in USD. Bank transfer rates and credit card conversion fees are the responsibility of the payer. We are not responsible for currency fluctuations or banking fees.
4. Charter Agreement
Vessel Assignment
While we describe specific vessels in proposals, Phinisi Charter reserves the right to assign an alternative vessel of equal or superior quality if operational circumstances require. We provide advance notice of any changes.
Itinerary Flexibility
Your charter itinerary is a suggested plan, not a guarantee. The Captain has authority to modify the itinerary based on weather conditions, sea state, guest interests, and safety considerations. We commit to providing an exceptional experience within these constraints.
Captain’s Authority
The Captain is the ultimate authority aboard the vessel regarding navigation, safety, vessel operation, and crew direction. All guests must follow the Captain’s instructions. Failure to comply may result in early charter termination without refund.
Crew & Services
Our crew provides navigation, hospitality, and water sports facilitation. The quality of food, beverages, and services reflects the charter cost and pre-agreed package. Additional services may be available for extra fees.
5. Guest Responsibilities
Health Declaration
Guests must disclose any medical conditions, allergies, medications, or physical limitations that could affect their safety or enjoyment. This information is confidential and necessary for crew preparation. Misrepresentation may result in denial of participation.
Guest Conduct
Guests agree to conduct themselves respectfully toward crew members and fellow guests. Behavior that endangers safety, violates others’ rights, or breaches local laws may result in immediate charter termination without refund. We reserve the right to refuse service to intoxicated or disruptive guests.
Prohibited Items & Activities
Guests may not bring weapons, illegal drugs, or excessive alcohol aboard. Fishing, hunting, collecting coral, or disturbing marine life are prohibited. Violations may result in termination and legal consequences under Indonesian law.
Water Sports & Activities
Snorkeling, diving, and water sports are optional and at your own risk. Guests must follow crew instructions and safety protocols. Phinisi Charter is not responsible for injuries or accidents during optional activities.
6. Liability Limitations
Assumption of Risk
Charter activities involve inherent risks including rough seas, marine life encounters, sun exposure, and fatigue. By booking, guests assume all risks associated with maritime travel and activities. Phinisi Charter and its crew are not liable for injuries, illnesses, or accidents occurring during the charter.
Injury & Medical Liability
While our crew provides basic first aid, we are not responsible for medical emergencies, evacuations, or complications. Guests are responsible for obtaining appropriate travel insurance covering medical treatment and evacuation to Indonesia’s limited medical facilities.
Property Damage & Loss
Guests are responsible for their belongings. Phinisi Charter is not liable for lost, stolen, or damaged personal items. We recommend travel insurance covering baggage and personal property.
Force Majeure
Phinisi Charter is not liable for damages or losses resulting from events beyond our control: severe weather, natural disasters, government actions, or other extraordinary circumstances. Guests are offered charter rescheduling or refunds per our cancellation policy.
7. Insurance Requirement
Phinisi Charter carries comprehensive vessel insurance. Guests are strongly encouraged to obtain travel insurance including:
- Trip cancellation & interruption coverage
- Medical & emergency evacuation insurance
- Personal property & baggage protection
- Travel delay & emergency assistance
We are not responsible for claims that could have been covered by insurance. Travel insurance is essential protection for charter investments.
8. Intellectual Property & Photography
Guests retain rights to personal photos taken during their charter. However, Phinisi Charter may use professional charter photos and footage for marketing and promotional purposes. Guests can request that their faces be excluded from promotional materials.
9. Modification of Services
Phinisi Charter reserves the right to modify services, itineraries, or terms if necessary for safety, legal compliance, or operational reasons. We provide advance notice when possible and offer alternatives or refunds if changes materially affect the charter.
10. Governing Law & Jurisdiction
These terms and conditions are governed by the laws of Indonesia. Any disputes arising from this agreement shall be resolved under Indonesian law. The charter agreement constitutes a contract performed in Indonesia, subject to Indonesian legal jurisdiction.
11. Severability
If any provision of these terms is found invalid or unenforceable, that provision is severed, and remaining terms remain in full effect. Invalid provisions are replaced with enforceable alternatives that reflect the original intent.
12. Entire Agreement
These terms, along with your booking confirmation and proposal, constitute the entire charter agreement. Previous negotiations, representations, or agreements not explicitly stated here are superseded. No modifications are valid unless in writing and signed by Phinisi Charter management.

What is included in the charter price?
The base price includes the vessel, captain and crew, fuel, and berthing fees. Meals, beverages, water sports equipment, and optional activities are outlined in your proposal.
Can you guarantee a specific itinerary?
While we plan meticulously, the captain may adjust the itinerary based on weather, sea conditions, or guest preferences. We prioritize safety and guest experience over fixed routes.
What if I need to cancel my booking?
Our cancellation policy offers refunds based on timing: 90% refund if cancelled 60+ days out, decreasing to no refund within 15 days. See our cancellation policy for full details.
Is travel insurance required?
While not required by us, we strongly recommend comprehensive travel insurance including trip cancellation, medical coverage, and evacuation insurance.
